Vacation Rental Lease Agreement
If signing or reviewing online, please print this Vacation Rental Lease Agreement for your records. This contains certain terms and conditions to which you agree to be bound by contract. Please read thoroughly before signing.
This lease is between the undersigned as “Lessee” or “Guest” or “You” and Hideaway Rentals, LLC as “Lessor” or “Owner” or “We/Us”. It is the responsibility of all guests to be familiar with the terms and policies of this Agreement.
The Property is located at: N990 Arbor Lake S., Lyndon Station, Wisconsin 53944. For weekly rentals, the property will be ready for occupancy at 4:00 PM local time on the beginning date of the lease and must be vacated by 10:00 AM local time on the ending date of the lease. Shorter stays may have earlier arrival times. An e-mail confirmation with arrival and departure dates will be sent as part of the payment invoice. A four digit door code will be set the day of arrival to a number provided by Lessee. Lessee shall pay as rent the rate agreed upon by you and Hideaway Rentals and confirmed on payment voucher, plus all applicable taxes and other charges. Accepted forms of payment are MasterCard, Visa, Discover, Traveler’s Checks, Cashier’s Checks, and Cash. Personal checks may be accepted if received forty-five (45) or more days prior to arrival.
SECURITY: In lieu of a security deposit, we will hold your credit card on file as security and guarantee for payment. If there are damages to this unit during your stay, we will bill your credit card and send you an invoice. If Owner discovers that there has been damage to the property or its contents while Lessee is the occupant, Owner will capture an amount from your credit card to cover the estimated cost of repairs. The amount captured will be an estimate and will probably be more than the actual cost of repairs. Owner will provide a statement of the damages and the cost of the repairs after all repairs have been completed. If there is a refund due, it will be returned to the credit card after all repairs have been made. Owner reserves the right to complete repairs ourselves at a rate of $20.00 per hour if Owner or its agent has the skills and knowledge to make the repairs. This will usually save time and money. If Owner attempts to charge your credit card for damages and the card is declined, you agree to pay damages by another method within ten (10) days of notification. By booking this unit, you agree to these terms.
You are responsible for all damages that occur to the property or its contents by you or any member of your group, individually or collectively, while you are the registered occupant of the property.
Any damage noticed upon arrival should be reported to the OWNER immediately. If damage is not reported, your credit card may be charged for the cost of the repair. All general maintenance should also be reported so the unit can be kept in good repair. In order not to be charged additional fees, the following must occur:
· a) No damage is done to the unit or its contents, including the linens.
· b) No items are missing upon the inventory check
· c) All debris, garbage and discards are placed in proper containers
· d) All checkout procedures are adhered to as outlined later in this lease.
· e) There was no exceeding the maximum occupancy of 10 (ten) people
· f) There was no smoking or evidence of smoking in or around unit
· g) Unit is left in neat condition
We do not offer any discounts or refunds due to bad weather or acts of god which may interfere with Guest’s occupancy. Please ask your insurance agent about travel insurance.
ABSOLUTELY NO PETS are permitted in rental units under any circumstances, NO Exceptions. If any evidence of a pet(s) is found in your unit or on the premises, you will be asked to vacate immediately with no refund of rent and the owner will automatically charge your credit card on file $500 for the cost to DEEP clean and carpet cleaning of the entire home. Also, per property insurance policy, no LESSEE dogs are allowed. LESSEE will be responsible for any insurance liabilities or costs associated with violating insurance policy terms including liabilities pertaining to dog bites.
Minimum Stay: This is a weekly rental between May and August. Weeks run Saturday to Saturday. If you have a question about a longer stay, please contact us directly. A two day stay is required September through mid May.
Inclusive Fees: Rates include a one-time linen setup and cleaning service at the time of departure. There is NO DAILY MAID SERVICE. An initial supply of trash liners, and toilet paper is supplied. Coffee filters are also supplied and a starter pack of coffee, creamer, and sugar. Please see more details sent with booking confirmation.
Utilities: Lessor will provide water, heat, electric, air, and trash removal. There is no telephone service provided. Unit does have a local phone book.
Accommodations: One king air bed, one queen bed, two twin beds in the same room, and two full sofa sleepers. Lessee supplies towels for outside use.
Maximum Number of Occupants: The house is to be occupied by no more than ten (10) people maximum at any time. Lessee/Guest warrants and represents that he/she is at least twenty-five (25) years of age, or if younger, will be accompanied on the premises by an adult guardian or parent. Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and /or rental money and the party will not be permitted to check-in. No chaperoned groups are permitted. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEPTIC SYSTEM. THEREFORE, IN THE EVENT LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN TEN PERSONS, LESSEE SHALL BE RESPONDIBLE TO PAY LESSOR THE SUM OF ONE HUNDRED ($100.00) DOLLARS PER PERSON IN EXCESS OF TEN PERSONS PER DAY FOR EACH DAY THE LESSEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN TEN PERSONS. If you have an overnight house party or overcrowd a house you will be asked to vacate with NO REFUND.
Lessee assures Lessor that the tenants will observe all terms and conditions of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
Lessee assures the Lessor that any tenant who violates any of the terms of this lease shall be immediately denied occupancy. Lessee shall remedy any damages or other expenses, which are caused by the tenant and /or the tenant’s guest(s).
Lessee agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
Lessee and /or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordnance, nor commit waste or nuisance on or about the premises.
Lessee agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, and may put in during the term of the lease, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
Lessee agrees that he/she shall not paint or make any alterations to the property, including changing existing locks or adding new ones, without the Lessor’s written consent.
Upon not less than 24 hours notice, Lessee shall make available to Lessor or his agent for the premises of entering to make necessary or convenient repairs and to show the premises to prospective tenants. In an emergency, Lessor or his agent may enter the premises at any time without securing prior permission from Lessee.
Lessee may not let, sublet or assign this lease for all or any part of the premises without prior consent of the Lessor.
If Lessee abandons or vacates the premises, Lessor may at his option terminate this lease, enter the premises, and remove all property subject to and at all times in accordance with applicable Wisconsin laws.
In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney’s fees to the fullest extent allowable by law, in addition to all relief at law or equity.
Either party may terminate this lease in the event of a violation of any provision of this lease by the other party in the manner and as provided by law.
Lessee assumes full responsibility for fulfilling the terms of the lease for the period stated and assure the Lessor full recourse for the payment of any amount outstanding from the total amount due in accord with the terms as stated above including any outstanding or unpaid charges that are the responsibility of the Lessee.
Cancellation Policy: When you reserve the premises more than sixty (60) days prior to arrive, a minimum of half the total charges is due upon booking with the balance due sixty (60) days prior to arrival. If you reserve the premises within sixty (60) days of arrival, payment in full in due upon booking. Cancellations made forty-five (45) days or more prior to arrival will be refunded in full less a $60 processing fee. Cancellations within forty-five (45) days will not be refunded. Please look into travel insurance. Cancellations and early departures due to inclement weather do not warrant any refund of rent.
HOLD HARMLESS: Lessee agrees to release and indemnify the Owner or Lessor and his agent from and against liability for injury to the person of the Lessee or to the members of his household or guests, resulting from any cause whatsoever except only such personal injury caused by negligence on the part of the Owner. Lessee agrees to indemnify and save Lessor harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the Lessee, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises. Owner attempts to maintain the Unit in the best of condition. Owner expresses no guarantees express or implied, regarding suitability for any particular purpose. Owner does guarantee that appropriate repair and /or replacement will be performed as soon as possible under prevailing circumstances. It is Lessee’s responsibility to immediately notify Owner of any issues that they incur during their stay so that the repair and/or replacement may be promptly taken care of. Owner is not responsible for any inconveniences for which Owner has no immediate control. These inconveniences may include, but are not limited to, the following: (i) breakdown of DVD players, television, washer or dryer, appliances; (ii)power outages; (iii) adverse weather and/ or road conditions; (iv) construction in the area; and (v) unit that is not decorated and/ or accommodated to Lessee’s individual tastes. Owner shall not be held liable, or otherwise take any responsibility, for any injuries that may occur to Lessee, and /or Lessee’s guests, that is caused or permitted to be caused by the intentional, unintentional, negligent, or careless acts of said Lessees and/or guests. By the written or electronic endorsement of this Agreement, Lessee agrees to forever hold-harmless and indemnify Owner from any liability and/or responsibility arising there from. Owner is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
Arbor Lake Neighborhood and Property Rules: Lessee may use the Lake. All persons using the Lake area do so at their own risk and sole responsibility. There is no life guard on duty. Owners assume no responsibility for any accident or injury in connection with such use. Persons using the lake agree with the owners for and in consideration of the use of the lake, to make no claim against the owners for or on account of any loss of life, personal injury, or damage to or loss of personal property.
No loud noise after 10:00 pm and before 7:00 am. Please be courteous to neighbors at all times.
Lavatory Use: Please, do not flush condoms, tampons, diaper wipes, or other materials other than human waste and toilet paper. Lessee is responsible for all damages caused due to flushing other than human waste and toilet paper.
No street parking. All vehicles must be parked in the driveway.
Lessee may use firepit in the yard with care and at his/her own risk. If firewood is in the yard, it may be used. If no firewood is available, it must be purchased locally. If you have questions, please ask. Lessee is responsible for any and all damages cause by runaway fire including fire department response charges. Please be cautious of conditions and only burn when safe. Millers Grocery Store in Lyndon has the fire conditions posted. The phone number is posted in the unit.
Locked Areas: Areas that are locked, such as Owner’s personal storage spaces, for which Lessees are not provided a key, are off limits to the Lessee. Any attempt to enter locked areas is cause for immediate termination of this agreement, forfeiture of all monies paid, and Lessee will be liable for any damage and/ or missing items.
Use of Grills: Please do not move the grill and use only the grill provided to reduce fire hazards.
Check-Out Procedures: We know you are on vacation and we do appreciate your business, but we do have to ask that you abide by our Check-Out Procedures.
Most of our guests follow all of these rules very nicely, but for the few that do not, this is notice that a $50.00 fee per incident or per hour which ever applies will be charged to your credit card on file in addition to and to the extent of remedies available to Owner pursuant to Wisconsin laws.
- Check-out time is by 10:00 am local time. Our managers and cleaners arrive at 10:00 am to start cleaning the unit
- Make sure the door and windows are locked when you leave the unit.
- Take all of the trash in the unit, including the bathrooms and bedrooms, to the cans outside the unit. Place recycling in the recycling bins and leave bins on porch.
- Put all dishes in the dishwasher, add provided detergent, and turn on. If something is not dishwasher safe, please wash by hand.
- Wipe down all kitchen counters and sweep or dust mop floors.
- Leave beds unmade that have been used.
- Leave wet towels hanging in bathrooms. Other dirty towels may be left in laundry basket.
- Make sure outdoor furniture is in original position.
- COMPLETELY empty the refrigerator.
Please leave the unit neat and orderly to avoid additional charges. If the cleaning crew finds that the home has been left excessively dirty, you will be billed for the additional cleaning time at a rate of $50.00 per hour. If the cleaning company or owners detect any evidence of smoking in the unit or on the property, Lessee will be billed an additional $200 to deodorize the home.
ENTIRE AGEEMENT. THIS VACATION LEASE AGEEMENT, COMBINED WITH ANY AND ALL POLICIES AND COMMUNITY RULES AND REGULATIONS (IF APPLICABLE), AND THE SEPARATE CREDIT CARD AUTHORIZATION SERVE AS THE ENTIRE AGREEMENT. NO ADDITIONAL PROVISIONS ARE EXPRESSED OR IMPLIED. THIS AGREEMENT SUPERCEDES ANY AND ALL PREVIOUS ORAL AND/OR WRITTEN OR ELECTRONIC ENDORSEMENT, LESSEES AGREE THAT THEY HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND ACCEPT ANY AND ALL TERMS, CONDITIONS, CONVENANTS AND RESTRICTIONS, WITHOUT EXCEPTION. THIS AGREEMENT DOES NOT BECOME BINDING ON OWNER AND RESERVATIONS ARE NOT CONSIDERED “GUARANTEED” UNTIL ACCEPTED AND CONFIRMED BY OWNER BY WRITTEN OR ELECTRONIC RECEIPT. Credit Card Authorization: I understand and consent to the use of the credit card provided without original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after leased premises are vacated. Charges may include (in addition to all other charges stated elsewhere herein): Unauthorized long distance telephone calls; if phone is provided in unit, satellite or cable television charges; damages beyond normal wear and tear; unreturned keys; damage to the septic system or plumbing caused by flushing items other than toilet paper and human waste. Separate Credit Card authorization needs to be returned before arrival.
